Yes that could be a bug:

python import xarray as xr d = xr.Dataset(coords=dict(x=5)) d.set_index({"x": "x"}) returns: TypeError: len() of unsized object

For your use case, however, you don't need to set time as an index. There are several ways how you can combine Datasets - depending on how your data actually looks like. The docs on combining may be useful. If your files are saved on disk, the docs on reading multiple datasets may be useful.
